The legal side of the purchase
A foreigner can own a condo freehold — full ownership — provided their unit fits within the foreign quota: 49% of the building's total floor area. The purchase funds must come from abroad in foreign currency, and the bank issues an FET certificate; without it the ownership cannot be registered. A foreigner usually holds a villa on a 30-year leasehold; renewals are a term of the contract, not the law.
On transfer at the Land Department you pay a 2% transfer fee on the appraised value, plus either 3.3% specific business tax (if the seller has owned the property for less than five years) or 0.5% stamp duty. The contract states which party pays what, and in what proportion. Before the deal, check the title, and make sure there are no maintenance arrears or encumbrances.
